It is the ultimate conflict of interest if the government and those close to the government (legislators, party officials, etc.) are the delegates because then the government would have a monopoly on any potential Constitutional reform in New York. Oral Arguments Made in New York State Supreme Court Case Against Silver for Using Public Funds in Lopez Settlement

“Our elected officials take an oath to obey the NY State and federal Constitutions,” said Schulz. “The prohibition regarding the use of public funds in aid of private undertakings is very clear. Mr. Silver has publicly admitted he did not handle the matter properly. The money, which belongs to the taxpayers, had no business being used for this purpose and must be put back.” Continue reading

Schulz Continues His Court Quest Against SAFE Act

Schulz believes the law was improperly enacted since he doesn’t think the message of necessity was warranted. “Three or four men in a room, for three or four hours, they cut a deal,” is how he described the activities before rank and file lawmakers, who tend to do what their leaders tell them, passed the measure back in January. SAFE Act Challenged in Appellate Court

The crux of Schulz’s argument, and almost everyone else calling for the repeal of the Safe Act, is the Message of Necessity the Governor and Legislature relied on to pass the measure so hastily.
