New California Law Rejects NDAA Indefinite Detention

This language of AB351 goes far beyond what has been considered in most other states, which focus solely on indefinite detention powers under the 2012 National Defense Authorization Act (NDAA), and nothing else. Donnelly’s legislation broadened the scope by recognizing that indefinite detention should not be complied with no matter what federal law is used to justify it. Donnelly confirmed this broad scope, “AB351 will prevent California from implementing indefinite detention for any reason.” Continue reading

California Bill to Nullify NDAA Unanimously Passes Committee

The legislation is designed to free California from having to comply with the National Defense Authorization Act (NDAA) of 2012, which does nothing to prevent the potential seizure and indefinite detention of U.S. citizens. We are a Rule of Law nation, born of the Enlightenment. We formed our federal government to work at the pleasure of Rule of Law States. We must remind ourselves (and the neo-federalists) that these laws were devised to protect a Sovereign People — by prohibiting the rule of unscrupulous men.

We must learn how to leverage our supreme laws and unalienable rights, effectively and enduringly. Learn to embrace State electoral politics. Michigan House Votes to Nullify NDAA: 107-0

Texas NDAA Nullification Bill Includes Criminal Charges for Federal Agents

At the close of 2011, Barack Obama signed the National Defense Authorization Act for the year 2012. In it are what some constitutional experts consider to be some of the greatest constitutional violations in American history. At issue are sections 1021 and 1022 which, in essence, create a new power for the federal government to “indefinitely detain” – without due process – any person. Indefinitely. On Indefinite Detention: The Tyranny Continues

The bad news from last week’s passage of the 2013 National Defense Authorization Act is that Americans can still be arrested on US soil and detained indefinitely without trial. Some of my colleagues would like us to believe that they fixed last year’s infamous Sections 1021 and 1022 of the NDAA, which codified into law the unconstitutional notion that some Americans are not subject to the protections of the Constitution. However, nothing in this year’s bill or amendments to the bill restored those constitutional rights. Continue reading

Virginia Governor agrees to House Bill 1160 with amendments

Gov. Bob McDonnell has agreed to an amended version of a bill from Delegate Robert G. Marshall, R-Prince William, that would prevent any state employee or member of the military of Virginia from participating in the detention of U.S. citizens without trial. Continue reading
